IT IS HEREBY ORDERED that the business of the Court shall be divided among the Judges as follows:
1. The Clerk shall Apportion equally among the five Judges all NEW cases, prisoner cases, and government contract cases which are routinely terminated by default judgment, including by way of illustration of such government contract cases but not of limitation of such government contract cases, SBA cases, student loan cases, and Veterans Administration cases.
2. All other cases shall be equally divided among the five Judges with due regard to the place where the action should probably be tried.
3. So long as the cases triable in Williamsport are less than 20% of all triable cases, the Clerk shall assign to Judge Muir cases normally triable in Harrisburg to the extent necessary to bring Judge Muir's triable cases up to 20% of those of the district.
4. At least three offices for Judge Muir and staff of two law clerks and one deputy clerk who accompany the Judge are necessary while he is trying cases away from Williamsport. If there is no courtroom available in Harrisburg for Judge Muir to try his Harrisburg cases during a given month or there are not three offices available for him and his staff during that period, Judge Muir shall try his cases normally triable in Harrisburg in Lewisburg if that be practicable, or, if counsel for all parties consent or if trial in Lewisburg is not practicable, in Williamsport.
5. Insofar as practicable, emergency matters shall be assigned to a Judge within the area where the cases ultimately will probably be tried, provided, however, that such matters shall be apportioned equitably among the five Judges, insofar as practicable, and provided further, that no Judge shall be obliged to travel from his or her station or from the place where he or she may be temporarily sitting for an emergency matter.
IT IS FURTHER ORDERED that this Order shall become effective when signed by all of the Judges of this District, retroactive to September 12, 1979, the date on which the foregoing policy was adopted.
